TERMS & CONDITIONS

Sole Agency [Lettings]:

A Sole agency is where Clifton Property Partners acts on your behalf to the exclusion of all other agents.  You will be liable to pay remuneration to Clifton Property Partners (in addition to any other costs or charges agreed) if at any time (or within six months of the termination of this Sole agency contract) a tenancy commences for the rental of the property, irrespective of whether the tenancy is finalised by Clifton Property Partners (CPP) with:

• A tenant introduced by CPP during the period of our Sole agency.
• A tenant with whom CPP had negotiations about the property during the period of our Sole agency.
• A tenant introduced by another Agent during our Sole agency period.

CPP Sole agency contract is subject to a minimum period of four weeks and will continue until either party gives seven days written notice to terminate.  In the unlikely event that it should be necessary to give seven days written notice to terminate, no other agent maybe instructed until the notice has expired or the minimum period has passed.

CPP standard Sole agency fee, for tenancies of six months or more, is 7% + VAT of the gross annual rent.
CPP Sole agency for Year 2 decreases to 5% +VAT, and then 3% +VAT for year 3 and further
CPP standard Sole agency fee, for tenancies of less than six months, is 20% + VAT of the gross annual rent.

Multiple Agency [Lettings]:

A Multiple agency is where CPP acts on your behalf alongside other agents.  You will be liable to pay remuneration to CPP (in addition to any other costs or charges agreed) if at any time (or within six months of the termination of this Multiple agency contract) a tenancy commences for the rental of the property, irrespective of whether the tenancy is finalised by CPP, with:

• A tenant introduced by CPP during this Multiple agency contract.
• A tenant with whom CPP had negotiations about the property during this Multiple agency contract.

CPP Multiple agency contract does not carry a minimum period and will continue until either party gives seven days written notice to terminate.

CPP standard Multiple agency fee, for tenancies of six months or more, is 10% + VAT of the gross annual rent.
CPP standard Multiple agency fee, for tenancies of less than six months, is 22% + VAT of the gross annual rent.

Renewal Fees [Lettings]:

Where the tenancy agreement is for an initial period of six months or more and is renewed or extended, whether negotiated by CPP or not, our standard commission payable is:

• 8% + VAT, for properties initially rented under our Sole agency
• 10% + VAT, for properties initially rented under our Multiple agency

of the total rent for the remainder of the tenancy, including any further extensions or renewals.  Fees, costs and charges will be deducted or invoiced in the same way that they are in the initial tenancy as detailed above.

Where the tenancy agreement is for an initial period of less than six months and is renewed or extended, whether negotiated by CPP or not, our standard commission is payable at the same percentage rate as agreed for the initial term.  This applies to all further renewals and extensions. Fees, costs and charges will be deducted or invoiced in the same way that they are in the initial tenancy as detailed above.
